Overview
These Terms of Sale define the commercial and transactional rules governing purchases and paid services offered through Art Times. The Terms of Sale apply to digital artworks, physical artworks, and any paid presentation, promotion, or facilitation services provided by Art Times in connection with artworks. These Terms of Sale are intended to protect buyers, sellers, creators, and Art Times by establishing clear rules on ordering, payments, delivery, licensing, authenticity statements, and dispute procedures. Where local law grants mandatory consumer rights, those rights remain unaffected.
Applicability and scope
These Terms of Sale apply to all transactions in which a buyer purchases digital artwork, physical artwork, or paid services related to artwork through Art Times. This includes paid content services, paid placements, paid presentations, and any other paid offering where Art Times acts as a contracting party or facilitates a transaction.
Where Art Times operates as an intermediary between a seller and a buyer, additional seller specific terms may apply. However, these Terms of Sale remain the baseline framework for payment flow, delivery obligations, rights clarity, and dispute handling. If a transaction involves third party processors such as payment providers, shipping carriers, or hosting providers, the relevant third party terms may additionally apply without diminishing the protections and obligations described here.
Definitions
For clarity, the following terms are used in these Terms of Sale. Art Times refers to the platform and its commercial offering, including paid services and any transaction related processes provided by Art Times. Buyer refers to any person or entity purchasing a digital artwork, physical artwork, or paid service through Art Times. Seller refers to the creator, rights holder, gallery, institution, or authorized representative offering an artwork for sale through Art Times where applicable. Digital Artwork refers to a digital product delivered electronically, including any specified usage license. Physical Artwork refers to tangible artworks delivered via shipment or handover, including originals, editions, and physical objects. Service refers to paid services provided by Art Times that may relate to artworks, such as facilitated presentation, visibility packages, or transactional support where applicable. Order refers to the buyer’s purchase request submitted through Art Times. Contract refers to the legally binding agreement formed upon acceptance of an order by Art Times or by the seller via Art Times as specified in the order confirmation. Delivery refers to making purchased digital content available for download or access or shipping and handover of physical artwork. License refers to the permission granted to the buyer regarding the use of a digital artwork subject to stated restrictions. Chargeback refers to a payment reversal initiated via a bank or card provider.
Pricing and payment terms
All prices displayed by Art Times are shown in the stated currency and may be subject to applicable taxes, fees, or shipping costs depending on the nature of the transaction and the buyer’s location. Where shipping applies, shipping costs, insurance, and potential customs duties are typically calculated separately and presented before checkout where feasible.
Art Times may offer multiple payment methods via third party payment processors. The buyer authorizes Art Times and its payment processor to charge the selected payment method for the total amount due, including taxes and any stated fees. Payment is generally due at the time of order placement unless Art Times explicitly offers alternative terms in writing. An order is not considered confirmed until payment is successfully processed and an order confirmation is issued.
Art Times may provide a receipt or invoice confirming payment. Invoice content may vary based on applicable tax requirements and the buyer’s location. If payment fails or is reversed, Art Times may suspend delivery, revoke access to digital downloads, or pause shipment until payment is resolved. Repeated failed payment attempts may result in order cancellation.
If a buyer initiates a chargeback without first engaging the dispute process set out in these Terms of Sale, Art Times may recover reasonable administrative costs to the extent permitted by law and may restrict future transactions.
Orders and contract formation
Placing an order through Art Times constitutes an offer to purchase under these Terms of Sale. The buyer is responsible for ensuring all order details are accurate, including delivery address, contact information, and selected product or service.
A contract is formed when Art Times or the seller via Art Times where applicable issues an explicit order confirmation. Automated acknowledgements of receipt do not necessarily constitute acceptance unless clearly stated.
Artworks and editions may be limited in quantity. Art Times reserves the right to reject an order due to availability, suspected fraud, incomplete information, or unresolved compliance issues. If an order cannot be fulfilled after payment, Art Times will arrange a refund for the affected amount in accordance with the Refund and cancellation policy section.
If a pricing or listing error is identified, Art Times may cancel the order and refund payments, or request buyer confirmation under corrected terms where legally allowed.
Digital services and delivery
Digital artworks are delivered electronically via download link, account access, email delivery, or another specified method. Delivery timelines vary by product type and may be immediate or scheduled.
The buyer is responsible for meeting any technical requirements stated in the listing, including compatible devices, software, storage capacity, and internet access. Art Times is not responsible for issues caused by the buyer’s incompatible systems or third party software.
If a digital file is corrupted or inaccessible due to a system error on the Art Times side, Art Times will provide a reasonable remedy, which may include redelivery or reactivation of access. Claims must be made within a reasonable period after delivery.
Unless otherwise stated, purchase of a digital artwork typically grants a limited, non exclusive, non transferable license for personal use. Commercial use, resale, redistribution, or public display may require a separate written license. Any license limitations stated in the listing are binding.
To protect creators and rights holders, Art Times may apply access limits, watermarking, or download restrictions. Attempts to bypass these measures may lead to termination of access and additional remedies where permitted by law.
Physical artworks shipping delivery and risk
Physical artworks are shipped using carriers selected by Art Times or the seller depending on the transaction structure. Shipment may require signature upon delivery and may be insured.
Art Times expects artworks to be packaged with reasonable care appropriate to the medium. Where professional crating or special handling is required, additional fees may apply and will be disclosed where possible.
Estimated delivery times are provided as guidance and may vary due to carrier delays, customs processing, weather events, or other external factors outside the control of Art Times.
Risk transfer rules vary by jurisdiction and transaction type. In many cases, risk transfers at the time the artwork is delivered to the buyer or the buyer’s designated carrier. Where consumer law mandates different rules, those mandatory provisions apply.
Buyers are responsible for customs duties, import taxes, and compliance with local import restrictions unless explicitly stated otherwise. Failure to pay duties or accept delivery may result in return shipment costs and administrative fees to the extent permitted by law.
If a delivery fails due to an incorrect address, unavailability to receive the shipment, or refusal to accept delivery, Art Times may charge re shipping costs or treat the order as cancelled subject to the Refund and cancellation policy.
Condition authenticity and documentation
Artwork condition is described based on available information at the time of listing. Minor variations may occur, especially for handmade works. Where condition is critical, the buyer should request clarification before purchase.
Where available, sellers may provide authenticity documentation, provenance details, or certificates of authenticity. Art Times may require sellers to provide reasonable substantiation for authenticity claims but does not guarantee provenance beyond the information provided unless explicitly stated.
For limited editions, the listing should specify edition size, numbering, and whether the artwork is signed. Any accompanying documentation described in the listing should be included upon delivery.
Where applicable, Art Times may provide purchase documentation or receipts. Any documents provided do not replace independent authentication services for high value acquisitions.
Refund and cancellation policy
Refund and cancellation eligibility depends on whether the purchase is digital, physical, or a service and on the stage of delivery or performance. Mandatory consumer rights remain unaffected.
Because digital content can be delivered instantly and is not typically returnable in the same way as physical goods, refunds may be limited once delivery or access has been provided. Where local law grants a withdrawal right, Art Times will comply. If a digital file is defective and cannot be remedied, Art Times may provide a refund or credit.
Physical artworks may be eligible for return within a stated period if returned in original condition and packaging subject to inspection. Return shipping costs and insurance responsibilities may be allocated to the buyer unless the return is due to proven damage in transit or material misdescription subject to applicable law.
If a physical artwork arrives damaged, the buyer must notify Art Times within a reasonable timeframe and provide documentation such as photographs of packaging and damage. Claims may be denied if packaging evidence is unavailable or if damage resulted from buyer handling after delivery.
Cancellations may be possible before shipment. Once shipment is initiated, cancellation may convert into a return request under the return rules subject to fees where permitted by law. Certain fees, such as expedited shipping, custom crating, or completed services, may be non refundable where clearly disclosed and permitted by law.
Disputes and chargebacks
Before initiating a chargeback, the buyer should contact Art Times with order details and supporting evidence. Art Times will review the matter and seek a reasonable resolution.
Disputes typically require documentation such as order confirmations, delivery records, correspondence, and photos for damaged items. Art Times may set reasonable timelines for submitting evidence to ensure efficient resolution.
Chargebacks should be used only when the internal dispute process fails or where required to protect the buyer. Unjustified chargebacks may lead to account restrictions and recovery of reasonable costs where permitted by law.
Art Times reserves the right to suspend orders or accounts if fraudulent activity is suspected and may request identity verification where appropriate.
Governing law and jurisdiction
These Terms of Sale are governed by the laws specified in the Legal Notice or applicable contracting entity information provided by Art Times unless mandatory consumer protection law requires otherwise. Jurisdiction and venue provisions apply as stated subject to mandatory local rules. Where appropriate, Art Times may offer alternative dispute resolution mechanisms in accordance with applicable legal requirements.
Additional protective notes
Art Times may update these Terms of Sale to reflect operational, legal, or regulatory changes. Updated terms may apply to future transactions, while existing confirmed orders remain governed by the terms in effect at the time of confirmation unless legally required otherwise. If any provision is found unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law.
